TERMS OF SERVICE
GnxOnline provides World Wide Web page hosting. GnxOnline reserves the right to suspend or cancel a customer's access to any or all services provided by GnxOnline when GnxOnline decides that the account has been inappropriately used or otherwise.
SERVER USE
Personal accounts are to be used by the primary owner only. Personal account holders are not permitted resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.
Customers may however resell our Reseller packages.
GnxOnline do not allow any of the following content to be stored on its servers:
Illegal Material or Material - Includes copyrighted works non copyrighted works, commercial audio, warez ,video, or music files, audio streaming and any material in violation of any Federal, State or Local regulation.Chat scripts or Irc bots, spamming activities.
Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of GnxOnline.
Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.
On Unmetered Bandwidth Accounts we do not allow video, or music files, audio streaming ,"file dumping".
"file dumping" The posting of files for download or storing of files for distribution commercial or non commercial.
Dedicated Bandwidth Accounts do allow video, or music files, audio streaming and "file dumping" .
UNLIMITED USE POLICY
High bandwidth usage: GnxOnline offers an unlimited use policy by maintaining very large ratios of bandwidth per customer. In rare cases, GnxOnline may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, GnxOnline reserves the right to impose the High Resource User Policy for the consideration of all customers.This policy does not apply to FIXED BANDWIDTH plans.
HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor utilization.
GnxOnline may implement the following policy to its sole discretion:
When a website is found to be monopolising the resources available GnxOnline reserves the right to contact and request the site be move to a fixed bandwidth plan . This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers.
99.9% UPTIME GUARANTEE
We aim at 99.9% uptime for your website in everything that we do .We make sure that our customers are fully compensated in the unlikely event that you should experience downtime whilst using our service. Our uptime guarantee is designed for our internal network and does not cover hardware failure and activities outside our network.And as a sliding scale in order to compensate you according to the level of outage. If the service is unavailable due to a non planned total outage for more than 0.1% (44 mins) of any given month we will fully refund the "per hour" value of the service for all hours over and above the 44 mins specified up to 1.40% (10hrs). In the unlikely event that the service is down for more than 1.40% (10hrs) but less than 3.3% (24hrs) in one month we will refund 50% of the service fee for that month. In the very unlikely event that the service is down for more than 3.3% (24hrs) we will refund 100% of the service fee for that month (i.e. 1/12th of the annual fee paid).This policy applies to FIXED BANDWIDTH plans
PAYMENT POLICIES
All accounts are set up on a prepay basis. Although GnxOnline reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established. Customers will automatically be email to renew there accounts.
No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after the online purchase has been made. At this point the customer's card will be charged automatically.
PAYMENT OPTIONS
Credit / Debit Cards:
GnxOnline accepts Mastercard, Visa (not Visa electron), Switch and Solo etc.
Cheque Payment:
This option is only available to customers who pay annually for their GnxOnline account. A credit / debit card number will still be required if customers require the facility to purchase domains and other services on-line. GnxOnline cannot guarantee that a service will be provided until after any received cheques have been cleared.
MONEY BACK GUARANTEE
The fourteen days money back guarantee starts from the date of the purchase as reflected on your world pay receipt. The money back guarantee does NOT apply to domain registrations or all in one accounts (domain name and hosting), it ONLY applies to hosting packages. ( Domain names are like property, once we have registered them for you, we can not undo the registration hence we cant offer a refund for them, this also applies to names registered incorrectly as a result of your having made a mistake during the signup process, so make sure you check the name you have filled in before you proceed to make payment.) The money back guarantee is subject to an administration fee, which will be deducted from the total amount to be refunded.( This covers set up fees and bank/world pay charges)
CANCELLATION AND REFUNDS
GnxOnline reserves the right to cancel the service at any time.If a customer contravenes GnxOnline' terms of service a refund will be not issued in the event of a cancellation.
Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation.
Fees charged on a prepay basis are non-refundable after the money back period. In event that an account has refunded there is an administration fee of approx $10.00 /£10 and account usage will be levied on the account. In addition some "non standard account features" such as Front Page Extensions ,Control Panels, MY SQL, Sql server, Live stats and set up fees are non-refundable. The designation of "non standard account features" is left entirely to the discretion of GnxOnline.
INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold GnxOnline harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against GnxOnline, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless GnxOnline against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with GnxOnline' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from GnxOnline' server.

GnxOnline will not be responsible for any damages your business may suffer. GnxOnline makes no warranties of any kind, expressed or implied for services we provide. GnxOnline disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by GnxOnline and its employees. GnxOnline reserves the right to revise its policies at any time.
